FenceSmartAI Terms & Conditions

These Terms govern your use of the FenceSmartAI platform and services (“Services”). By subscribing or using our Services, you agree to them.

FenceSmartAI provides a software platform for fencing contractors, including CRM, messaging, automation, AI integrations, and support.

3. Accounts & Access

  • You are responsible for your account and authorised users.

  • Do not share logins outside your business.

4. Fees, Billing & Renewals

  • Subscriptions are billed monthly or annually in advance.

  • Plans auto-renew until cancelled.

  • Fees are non-refundable (except where law requires).

5. Fair Usage (Communications)

  • Plans include generous allowances for SMS/calls sized for a typical small/medium sized fencing installation business.

  • No spam or abusive use.

  • Excessive usage may require an upgrade or limits.

6. Acceptable Use

You may not use FenceSmartAI for:

  • Unlawful activity.

  • Spam or unsolicited messages.

  • Harassment or abuse.

  • Storing or distributing illegal content.

You must comply with telecom and privacy laws (opt-ins, opt-outs).

7. Data Protection & Roles

  • You (the contractor) are the Data Controller for your customer data.

  • FenceSmartAI acts as Data Processor.

  • You must obtain necessary consents and only upload lawful data.

8. Domains, Phone & Integrations

If we procure domains, phone numbers, or third-party services for you, we manage them on your behalf.

9. Snapshots & Configuration

Your sub-account is provisioned from a FenceSmartAI snapshot.
Core automations and integrations cannot be altered directly.

10. Support & Availability

We provide reasonable support during business hours.
Occasional maintenance windows may apply.

11. Intellectual Property

  • FenceSmartAI IP: workflows, templates, and documentation remain our property.

  • Your content: you retain rights to your own data and branding.

12. Suspension & Termination

  • We may suspend/terminate for breach, non-payment, or unlawful use.

  • You may cancel anytime; access continues until end of paid term.

  • Data export requests must be made within 30 days of termination.

13. Warranties & Liability

  • Services are provided “as is.”

  • No warranty of uninterrupted use.

  • Liability capped at fees paid in the prior 12 months.

14. Governing Law

These Terms are governed by the laws of England & Wales.
Disputes are subject to the courts of England & Wales.
